Um - SURE THEY CAN! It's called a majority vote. It might stink for the person whose rights are being infringed, but it's not illegal or unjust. Think of the alternative: requiring unanimity and never getting any legislation passed.
Although I disagree with Prop 8, I don't think Melissa Etheridge has any experience reading anything dealing with statutory authority in this country - Hello, Lawrence v. Texas! The state can legislate and base it on morality - that's their legitimate state interest. Whether you agree with it or not is a different story, but it doesn't mean morality is NOT a valid argument for the state or voters to want to uphold. It's the history of this country that shows many crazy state statutes have been upheld based on 'morality.' Now, is it moral to deny equal protection and equal rights to human beings? No, but that's a different story. I do believe gay rights is the civil rights issue of the new millenium. We're going to look back at these times and be shocked this is how states have dealt with the situation and that Americans across the board tried to deny rights to gays as they did to blacks in the '60s and before.
