The only way I can imagine this movie flying is to leave all mention of the Joker aside, besides a quick tidbit of someone talking about his stay at Arkham Aslyum(They could twist that into a little mentioning of Harleen Quinzel as well, to please the comic fans). Likewise, remodeling the Riddler would probably be a good way to go, using the classic green evening suit approach. In fact, the only way anyone will find me in the theater is if they finally give Eddy a well-deserved second shot. Perhaps a less... Uma-y Poison Ivy as well?
