A will wouldn't have helped in this situation. With insurance policies you name beneficiaries. If Whitney was named as the beneficiary, the money is hers and not subject to the provisions of a will. If Whitney's father had wanted his wife to have the insurance money, he should have named his wife as the beneficiary. If he didn't, there must have been a reason. I guess the best argument the wife has is that Whitney was named the beneficiary because she (according to the story here) provided the money for her father to get the condo so her father maybe intended the insurance policy to pay her back for that -- if so, Whitney probably should pay off the condo. However, that should also mean that she, and not her stepmother, owns it. There could be an issue re: title to the condo. Maybe Whitney and her dad didn't have the presence of mind to put Whitney on title and stepmommy isn't willing to sign it over. But for someone with Whitney's means to end up in a situation like that would be just stupid. That's what lawyers and real estate agents are for.
