If you recall, last episode of last season, he didn't want to do the show any more, she clearly does. Jon's mistake was getting photographed with his "girlfriend" by the tabloids. This is what all the tears are about. Kate knows her popularity is not good with viewers and they're spinning it that she is the injured party when she signed off on his "other life". In the first episode of this season, Jon is infattic that he NEVER cheated on Kate. This is because they have been separated for some time now. Viewers want to see the entire family together. It has been clear via blogs and websites that Kate's nasty, bitchyness has not been going over well with fans. TLC even had to instruct her to be nicer to the boys since she never misses a chance to tell them how "icky" they are. The birthday episode which was filmed March 28th, a mere 60 days ago, their agreement was alsready in place - they appeared very relaxed with each other, with the situation at hand and Kate was not the least upset Jon wasn't around for her Birthday. While I do not like who/what Kate has become, she has every right to a career - I don't agree with leaving the children for book signings and speaking engagments. That was not her job. Their job was to film this reality show. The other stuff is fringe work - not her job!
