Honestly, I don't think there will be a custody battle. I think Kate will get full and Jon will get weekend visitation. I think this is very sad though! if they can't stay together...who can!!!

I do agree that kids that age hit their head all the time. My son just turned 1yr old and he's bumped into serveral things, but never has he been successful at climbing out of his playpen! It says she witnessed the baby fall....she should have NEVER let the baby climb on the pen! Also, if a child hit their head - you shouldn't let them fall asleep soon after.
